Get Ahead: Year 11 Summer School (2024)

Important Information

  1. These Terms and Conditions apply to the parent/guardian (“you”) of a child (“the Participant”) who has received an offer from Northeastern University – London (“the University”) to participate in the Get Ahead: Year 11 Summer School 2024 (“Summer School”). For the purposes of this document, ‘guardian’ also refers to ‘legal guardian’ as referenced throughout the Parent/Legal Guardian Agreement to Participate Form.
  2. If you decide to accept this offer on behalf of the Participant, an agreement will be formed between you and the University. Your rights and obligations to the University and the University’s rights and obligations to you and the Participant arising under that agreement are set out in this document.
  3. You are required to read, and where appropriate sign, the Parent/Legal Guardian Agreement to Participate Form.

Accuracy of Information

  1. By accepting the offer on behalf of the Participant, you confirm that the information provided on their application form and in connection with their application is true, complete and accurate, and that no information requested or other material information has been omitted. The University reserves the right to establish the authenticity of information provided on and/or in connection with the application and it reserves the right to cancel the application and terminate your agreement and/or withdraw the Participant from the University if it determines that false, incorrect, incomplete and/or misleading information has been provided in support of their application by you, by the Participant or by any other person acting on their behalf.

Language Requirements

  1. Summer School is taught in English, and the Participant must possess a good standard of English language and comprehension to participate. The University does not accept liability for any inconvenience or failure to attend arising from a lack of English language knowledge and proficiency.

Material, Services and Conduct

  1. Unless indicated otherwise, the activities do not include travel or accommodation costs, insurance or other costs that might arise prior to or during Summer School. Summer School will be delivered on the University’s campus at Devon House, London.
  2. Summer School outlines and course content are correct at the time of going online or to print.
  3. The University has designed Summer School to provide prospective University students with a University experience and to support their journey in learning, both academically and socially. This learning will be taken at the participant’s own pace and might not be evident at the time of Summer School but may be evident further on in their educational journey.
  4. The University reserves the right to remove the Participant from Summer School or exclude them from University premises if their behaviour or demeanour is considered unacceptable. For further information, please refer to Code of Behaviour – Get Ahead: Year 11 Summer School.
  5. After you have accepted the offer of a place on behalf of the Participant, you have a statutory right to cancel your acceptance within 14 days without giving any reason under the Consumer Contracts (Information Cancellation and Additional Charges) Regulations 2013. The cancellation period expires after 14 days from the date you accept the offer.

Cancelling Your Acceptance

  1. To exercise your right to cancel, you must inform the Widening Participation Team in a clear written statement (e.g. an email), of your decision to cancel this agreement. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
  2. The University will collect and process a range of information about the Participant as part of the application and registration procedures. In addition, the University will also monitor the Participant’s attendance at Summer School to issue their certificate. Therefore, it is necessary for the performance of this agreement that the University collects and processes these data.

Data Protection

  1. All data are held and processed in accordance with the requirements of the Data Protection Act 2018. Information is normally confidential between the applicant, appropriate staff at the University and, in the case of international applicants, the UKVI. In some cases, where programmes have been developed in collaboration with partner organisations, application data may also be shared externally. In the interests of detecting and preventing fraud, the University also has the right to share information with outside organisations such as the police and local authorities.
  2. For marketing purposes only, the University keeps a record of yours and the Participant’s contact information for up to five academic years after completing Summer School, which you or the Participant can however unsubscribe from. After five years, the contact information is removed from our system.

Intellectual Property

  1. The University reserves all rights and interests in any copyright, design right, registered design, patent or trademark arising as a result of the Participant’s work in conjunction with any member of staff or other participants at the University for a purpose associated with the University. The University will acknowledge their role in the development of intellectual property.
  2. Copyright in the Participant’s original work, such as class work, essays, projects and computer-generated material, will belong to the Participant. This work will be returned to the Participant at the end of the programme.

Liability

  1. If the University fails to comply with these terms, the University is responsible to the Participant for any direct loss or damage they suffer that is a reasonably foreseeable result of the University breaking this agreement or the University failing to use reasonable care and skills, however, the University is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the agreement was made, both the University and the Participant knew it might happen, for example, if the Participant discussed it with the University before entering into the agreement. The University will not, however, be responsible for any loss or damage the Participant may suffer which is attributable to your or their own fault and/or the fault of a third party.
  2. The University does not in any way exclude or limit its liability for:
    1. Death or personal injury caused by its negligence;
    2. Fraud or fraudulent misrepresentation;
    3. Any liability which cannot be limited or excluded as provided for under section 57 of the Consumer Rights Act 2015.
  3. The University is not responsible for delays or events outside its control which it could not have foreseen or prevented even if it had taken reasonable care. If the University’s performance of its services is affected by an event outside the University’s control, then the University will contact you as soon as possible to let you know and the University will take steps to minimise the effect of the delay. Provided the University does this, the University will not be liable for any delays caused by the event but if there is a risk of any substantial delay you may contact the University to end the agreement. The University reserves the right to change or cancel parts, or all, of the programme and/or agreement.

General Matters

  1. Your agreement with the University is between you, the parent/guardian, and the University and only these two parties can enforce it. The Contracts (Rights of Third Parties) Act 1999 does not apply.
  2. Although the contracting entities will not change, the University reserves the right to change the name of Northeastern University – London and/or the trading name under which it currently operates.
  3. The agreement shall be governed and construed in accordance with the laws of England and Wales. By accepting the offer on behalf of the Participant, you agree to abide by these Terms and Conditions and submit to the non-exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes which may arise out of, or in connection with, the agreement.

Further Consumer Rights

  1. As a consumer, you will always have legal rights (including statutory remedies) in relation to services not carried out with reasonable skill and care, or if the materials the University uses are faulty or not as described.
  2. For further details of your legal rights (including statutory remedies) you can visit your local Citizens Advice, Trading Standards office and/or visit the Competition and Markets Authority website.
